Agreement

These Terms of Use (the "Terms") are a legal agreement between you and TrailBear Technologies Inc. ("TrailBear", "we", "our"), 170-422 Richards St, Vancouver BC V6B 2Z4, Canada. They govern your use of the TrailBear mobile application and website.

By creating an account or using TrailBear, you accept these Terms. If you do not accept them, do not use the app.

Safety Disclaimer

Read this section carefully. It describes the limits of what TrailBear can tell you.

TrailBear displays wildlife sightings reported by members of the community and imported from public data sources. These reports are crowdsourced and unverified. We do not confirm that any reported sighting occurred, that the species identification is correct, or that the location and time are accurate.

The absence of a sighting does not mean the absence of an animal. Most wildlife is never reported. An area showing no sightings may still hold bears, cougars, or other wildlife. Never treat an empty map as evidence that an area is safe.

Some sighting locations are deliberately offset from their true coordinates to protect animals from harassment and poaching. Locations shown are approximate by design.

TrailBear is an informational tool. It is not a substitute for emergency services, for proper backcountry preparation, for carrying and knowing how to use bear spray, or for your own judgement in the field. Do not rely on the app for decisions affecting your safety. In an emergency, contact local emergency services directly.

Assumption of Risk

Travelling in wildlife country is inherently dangerous, and you accept that danger when you go.

Encounters with bears, cougars, and other wild animals can cause serious injury or death. No application, guide, or amount of preparation removes that possibility. Wildlife is unpredictable, and the outdoors carries risks that cannot be eliminated.

By using TrailBear you acknowledge these risks and voluntarily accept them. You accept that sighting data is crowdsourced, incomplete, and may be wrong; that an area with no reported sightings may still hold wildlife; and that every decision about where to travel, when to turn back, and how to respond to an animal is yours alone. These risks are yours whether or not you consulted TrailBear beforehand, and regardless of what the app did or did not show.

To the fullest extent permitted by law, you release TrailBear Technologies Inc. from any claim arising out of a wildlife encounter, injury, or loss sustained while travelling in an area covered by the service, including any claim based on the accuracy, completeness, timeliness, or absence of sighting data.

Accounts

You must be at least 13 years old to create a TrailBear account. An account is required to report a sighting, post a comment, or subscribe to TrailBear Pro. Browsing the map does not require an account.

You are responsible for keeping your account credentials secure and for activity that occurs under your account. Provide accurate information when you register, and keep it current.

Objectionable Content and Abusive Users: Zero Tolerance

TrailBear has a zero-tolerance policy for objectionable content and abusive users.

You may not submit, upload, or post any content that is unlawful, harassing, threatening, abusive, defamatory, hateful, obscene, sexually explicit, violent, invasive of another person's privacy, or otherwise objectionable. You may not impersonate another person, submit knowingly false sighting reports, or use TrailBear to locate wildlife for the purpose of harassing, baiting, harming, or poaching it.

Every sighting, photo, and comment in TrailBear can be reported using the Report action on that item. You can also block any user, which hides all of their content from you and flags the account for our review.

We review every report and act within 24 hours. Content found to be objectionable is removed, and the user responsible has their account terminated and is ejected from the service. We may remove content and terminate accounts at our sole discretion, without notice and without refund.

To report content or a user outside the app, email info@trailbear.app.

Your Content

You keep ownership of the sighting reports, photographs, and comments you submit ("Your Content"). You are responsible for Your Content and for having the rights to submit it.

By submitting Your Content, you grant TrailBear a worldwide, non-exclusive, royalty-free, transferable licence to host, store, reproduce, adapt, publish, and display it in connection with operating and promoting the service. This licence exists so we can show your sighting on the map to other users. It ends when you delete Your Content, except for copies retained in backups or where we must keep a record for safety or legal reasons.

You confirm that any photograph you upload is yours to share, does not contain other people's personal information without their consent, and does not infringe anyone's rights.

TrailBear Pro Subscriptions

TrailBear Pro is an auto-renewing subscription offered at $6.99 CAD / $4.99 USD per month or $49.99 CAD / $39.99 USD per year. The annual plan includes a one month free trial for new subscribers; if you do not cancel before the trial ends, the first year is charged automatically. Prices in other regions are set per storefront and are shown in the app before you purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate then in effect.
• You can manage or cancel your subscription in your device's App Store account settings. Deleting the app does not cancel a subscription.
• Safety information and the sighting map are free and are never placed behind the paywall. Pro adds capability, such as proximity alerts and custom alert zones.

Refunds are handled by Apple under the App Store terms, not by TrailBear directly.

Acceptable Use

You agree not to:

• Submit false, misleading, or deliberately inaccurate sighting reports.
• Use the app to seek out, bait, harass, feed, or harm wildlife.
• Scrape, bulk-download, or resell TrailBear data.
• Attempt to reverse the coordinate offsets applied to protected species.
• Interfere with the operation of the service, or attempt to access accounts or data that are not yours.
• Use the service in violation of any wildlife, park, or privacy law that applies to you.

Third-Party Content

TrailBear displays wildlife observation data and photography from iNaturalist under CC0 and CC-BY licences, with attribution shown alongside each photo, and historical incident data published by Parks Canada. We do not control that content and are not responsible for its accuracy.

Termination

You may stop using TrailBear at any time and can delete your account from Settings. We may suspend or terminate your access immediately if you breach these Terms, in particular the zero-tolerance policy above. On termination, your right to use the service ends immediately.

Disclaimer of Warranties

TrailBear is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any sighting data is accurate or complete.

Limitation of Liability

To the fullest extent permitted by law, TrailBear Technologies Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the service. This includes any injury, loss, or damage arising from reliance on sighting data or safety information in the app.

Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose, or $100 CAD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages, so parts of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless TrailBear Technologies Inc., together with its directors, officers, employees, and contractors, from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your use of the service, any content you submit, your breach of these Terms, or your violation of any law or of another person's rights.

This obligation survives the termination or deletion of your account.

Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes by email or in the app. Continued use after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict of law rules. The courts of British Columbia have exclusive jurisdiction over any dispute arising from these Terms.
